1. Agreement to Terms

Welcome to KinderSuccess, an early childhood educational application developed and operated by KTM Connect LLC ("we", "us", or "our"). By downloading, installing, accessing, or using KinderSuccess (the "Application"), you ("you", "User", or "Parent/Guardian") agree to be bound by these Terms of Service and Legal Disclaimers ("Terms"). If you do not agree to these Terms, do not install or use the Application.

2. Educational Practice Disclaimer & No Academic Guarantees

KinderSuccess is designed solely as an educational supplement and practice aid for early literacy, phonics, writing, and early mathematics.

  • Not Formal Schooling or Therapy: KinderSuccess is not an accredited educational institution, special education provider, or speech/occupational therapy program.
  • No Guaranteed Outcomes: Every child learns at their own unique pace. We make no representations, warranties, or guarantees regarding specific learning outcomes, school readiness scores, gifted and talented program admissions, reading levels, or test results.

3. Intellectual Property & Non-Affiliation Disclaimer (Spalding / Curriculums)

KinderSuccess incorporates foundational English phonics and explicit multi-sensory phonograms based on general linguistic principles and the public domain structure of the 70+ English speech sounds.

Trademark Notice: "The Spalding Method" and "The Writing Road to Reading" are trademarks of Spalding Education International. KinderSuccess and KTM Connect LLC are independent entities and are not affiliated with, sponsored by, authorized by, or endorsed by Spalding Education International or any other curriculum trademark holders. Any descriptive references to educational methodologies or sequence comparisons are made strictly under the doctrine of nominative fair use for descriptive and educational clarity.

4. License Grant, One-Time Purchase & Store Policies

Upon purchasing KinderSuccess, KTM Connect LLC grants you a personal, non-exclusive, non-transferable, revocable license to install and use the Application on compatible devices that you own or control, solely for personal, non-commercial, family educational use.

  • Billing & In-App Purchases: All financial transactions, free trial activations, and one-time unlock purchases are processed securely and directly by the third-party platform provider: the Apple App Store (Apple Inc.) or the Google Play Store (Google LLC).
  • Refunds: Refund eligibility, processing, and disputes are governed exclusively by the terms and policies of the respective store platform through which the purchase was made. KTM Connect LLC does not directly process or issue financial refunds.

5. Application Availability, Maintenance & Sunset Policy

KinderSuccess is built with a local-first, offline-supported architecture that allows existing users to continue practicing phonograms and stories on their devices without depending on continuous remote cloud servers.

  • Provided "As-Is": The Application is delivered on an "AS IS" and "AS AVAILABLE" basis. While we make reasonable efforts to maintain compatibility with modern operating system updates, KTM Connect LLC does not warrant or guarantee perpetual updates, compatibility with future hardware or OS releases, or uninterrupted service.
  • Right to Sunset or Modify: KTM Connect LLC reserves the right, at its sole discretion, to modify, update, suspend, delist, or discontinue the Application (or any feature thereof) at any time. In the event the Application is sunset or removed from sale, existing downloads and local functionality will remain subject to the hardware and operating system compatibility of your device.

6. Parental Supervision & Child Safety

KinderSuccess is intended for young children under the direct supervision, guidance, and discretion of a parent, legal guardian, or certified educator.

  • Parents and guardians are solely responsible for managing screen time duration, ambient sound and volume levels, and general device handling.
  • Our Application does not contain external web links or purchasing mechanisms in child-accessible modes; all configuration settings are protected behind the Parent Portal gate.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KTM CONNECT LLC, ITS FOUNDERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APPLICATION.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE PURCHASE OF THE APPLICATION.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State in which KTM Connect LLC is registered, without regard to its conflict of law principles.
